TO ALL ASSOCIATE MEMBERS OF THE ASSOCIATION:

Dear Sir,

There has been a consistent request from our Supply Chain Partners, particularly our Fabric Suppliers, to include them in our Arbitration Process. In other words, requesting CMAI to Arbitrate in their disputes with Garment Manufacturers.

Till date , we have been avoiding taking this step due to the heavy pressure of work and the objective of giving priority to our Members. However, now that the work load has eased, and with our increasing engagement with our Supply Chain partners, the Office Bearers have decided to include our Associate Members in the Arbitration process in a limited manner, on an experiment basis. If this experiment succeeds, we intend to expand the base in a phased manner.

To begin with ,  therefore, with effect from 1st April 2023, we will be opening up the Arbitration process to those who are participating in our FAB Shows, starting with the 3rd FAB Show on 26th, 27th, and 28th April, 2023.

The Terms are as follows:

  1. CATEGORY : ASSOCIATE MEMBER – FAB

2.      ELIGIBILITY: Associate Members who Participate in the CMAI FAB SHOW ( 3rd FAB Show onwards)  Existing Associate Members who participate in the FAB Shows will be automatically transferred to the Associate Member – FAB Category.

3.      MEMBERSHIP DURATION:  FINANCIAL YEAR – 1ST APRIL TO 31ST MARCH,

Renewable each year till the Membership Category is continued. 

4.      MINIMUM REQUIREMENT:

a.       Members of this Category will have to Participate in at least ONE FAB Show in the Financial Year in order to remain eligible for this Category.

b.      The Member must carry the Arbitration Clause in writing in their Contracts / Invoices:

CMAI ARBITRATION CLAUSE

“All disputes, or differences arising between the Parties out of or relating to this Contract shall be resolved under “Arbitration Rules of CMAI and the Award made in pursuance thereof shall be binding on the Parties.”

c. Complaints will be taken up for Arbitration only where payments have been delayed by more than 6 months

5.      CATEGORY TRANSFER: In the event of the Category being discontinued, the Membership under this Category automatically ceases. However, such Members will have the option to transfer to the General Associate Member Category for the balance duration of their Membership.

6.      ALL OTHER TERMS AND CONDITIONS OF ASSOCIATE MEMBERS CURRENTLY IN FORCE WILL APPLY TO THE ASSOCIATE MEMBER – FAB CATEGORY

7.      ASSOCIATE MEMBERS – GENERAL: All other Associate Members will be classified as ASSOCIATE MEMBER – GENERAL

8.      All current Associate Members have the option to switch to Associate Member FAB Category subject to them meeting the eligibility criteria.

9.      ALL TERMS AND CONDITIONS OF THE CMAI ARBITRATION PROCESS WILL CONTINUE TO APPLY.

Members are requested to take note of the above New Category.
